Why a new pool fence law?

We can't say it enough: children's safety is priceless. Unfortunately, drowning in residential pools remains a tragic scourge in Quebec, and often it comes down to poor access protection—like a pool fence gate left ajar or no longer locking properly.

It's precisely to curb these statistics that the government has tightened the Regulation on Residential Pool Safety. Whether you have an in-ground, semi-in-ground, or above-ground pool, the rules are now unequivocal. The good news is that if your current fence is wooden, it's very easily adaptable to the new standards, and you definitely don't need to start from scratch.

The end of "grandfathered rights": 2027 deadline

For a long time, if your pool predated certain standards, you had that famous "grandfathered right" that exempted you from applying them. Well, that loophole no longer exists.

The deadline you absolutely must remember

If your pool was installed before November 1, 2010, you officially have until September 30, 2027 to bring your fence 100% into compliance. Attention: if your pool was installed AFTER that 2010 date, your yard must ALREADY BE COMPLIANT today or you're liable for penalties.

Quebec cities (from Montréal and Laval to Terrebonne) take this very seriously: we're talking hefty fines and potential issues with your home insurance if you don't have a secure barrier. Don't wait until the last minute or inspectors show up at your door!

What are the compliance rules?

Here are the requirements in simplified form. Good news: these are all things we can correct during a simple wooden fence renovation and repair visit without having to replace your existing posts.

1. Minimum fence height

Your fence must measure at least 1.2 metres in height (that's 48 inches or 4 feet), measured from the ground upwards, all the way around the perimeter protecting access to your residential pool water.

2. Maximum spacing (underneath and between boards)

Nothing too wide! The gap between your wooden boards, or the space between the bottom of the fence and the grass, must never allow a spherical object of 10 centimetres (4 inches) in diameter to pass completely through. Why? To prevent a very young child from being able to squeeze through without getting caught.

3. Anti-climbing (Our #1 wooden repair)

A child absolutely must not be able to climb over the fence from the outside like they're climbing a ladder. In other words, all horizontal wooden cross-braces (like the 2×4s holding your boards) must be attached exclusively to the inside (toward the pool water). Also, no objects that could help with climbing (a water heater, heat pump, or filter) must be located less than 1 metre from the enclosure.

4. Door latches and hinges (The gate)

This is where 80% of fences fail inspection. The law requires two absolute safety devices on your access gate:

• Self-closing: The door hinge must have a strong, properly adjusted spring to bring the pool gate back into the closed position on its own, simply with the wind or without anyone touching it.
• Self-locking: The latch must engage and lock automatically. Furthermore, it must either be placed on the inside (toward the pool), or be mounted very high (at least 1.5 m from the ground) to remain completely out of reach of curious young ones. Did you know? (Those famous cedar hedges)

Forget cedar hedges! Even if they're opaque, beautiful, and dense, municipalities and the Quebec government do not recognise them in any way as a valid or legal safety barrier. A real rigid wooden fence, chain-link, or metal is mandatory.
